What is maternity benefit?

Maternity leave protects the biological, adoptive or foster mother for 16 weeks, paid at 100% of the regulatory base directly by Social Security.

The first 6 weeks are mandatory rest immediately after birth. The remaining 10 weeks may be taken continuously or split up until the child turns 12 months old.

    Issued by your company's HR department. Certifies your employment status, job category and salary.

    Mutual insurance provider details Required
    Name and number of the mutual insurance provider covering your temporary incapacity.

Frequently asked questions

What prior contribution periods are required?
It depends on age: under 21, no minimum required; 21 to 26, 90 days in the previous 7 years or 180 days over your whole working life; over 26, 180 days in the previous 7 years or 360 days over your whole working life.
Can I receive the benefit if I have no contract at the time of birth?
Only if you are registered or in an equivalent status (such as unemployment). If you are not contributing at the time of birth, a non-contributory benefit may apply. Ask us about your case.
Can I work part-time during the leave?
In principle, no — maternity leave is incompatible with working for the same company. However, if it's a different company or activity, it may be compatible. Ask us.
What happens if the baby is in the neonatal ICU?
Maternity leave does not start counting until the baby is discharged from hospital. The weeks the baby spends in the ICU are added to the end of the leave.
